Operator and contact: ARC INTELLIGENCE PTY LTD, ABN 26 698 244 610, ACN 698 244 610, operator of AI Fitness, based in Western Australia, Australia; support@aifitness.com.au. Effective date: 16 October 2026. This notice describes consumer health data handled in connection with AI Fitness where the applicable law uses that category.
1 Categories and sources
Depending on your choices and the feature, consumer health data may include physical measurements; fitness, activity and nutrition records; dietary restrictions and allergies; injuries, conditions, medication information and health limitations; health-related conversations and media; connected-device readings; and estimates or inferences about health. Location or other information may become consumer health data where it identifies or can reasonably indicate seeking or receiving health services.
Sources include you, your use of the Services, connected services you authorise and inferences generated from those records.
2 Purposes of collection and use
We use health data for the specific functions you request:
- Measurements, goals, activity and nutrition records support your saved history, progress, exercise and meal-planning functions.
- Conditions, medication information, allergies and limitations you provide may inform personalised context and safety-related information; they do not make the output clinical advice.
- Health-related messages, photos, voice and other submitted media support the AI answer, scan or media analysis you request.
- Connected readings, routes and related estimates support authorised tracking, maps and sharing functions.
- Relevant reported content and records may be used to investigate a complaint, safeguard users or meet a specific legal obligation.
Acceptance of general terms does not authorise unrelated future uses of health data.
3 Disclosure and sharing
Cloud hosting and storage providers may process the private records used by server-based features. AI and speech providers may process health-related requests, selected profile or plan context and submitted media for the answer or analysis you request. Communications, support and security providers may process relevant records to deliver messages, address your enquiry or investigate misuse. Content you choose to share goes to the audience you select. The amount and category sent depend on the feature. Contact support for recipient information applicable to your records. This notice does not grant a general right to share health data with affiliated businesses for their own independent purposes.
We obtain separate collection or sharing consent where required, or rely only on a specifically applicable requested-service exception. A service-provider contract does not automatically make every disclosure exempt. This notice and general terms are not a sale authorisation. Any legally permitted sale requiring a separate authorisation would require that authorisation before the activity.
4 Choices and rights
Contact support@aifitness.com.au to request applicable confirmation, access, withdrawal of consent or deletion rights, including required information about recipients. We verify requests proportionately and respond within the applicable statutory period. Withdrawal stops future consent-based processing within the required period and may disable the affected feature.
If we decline a request, we explain why and provide the required appeal process by email to support@aifitness.com.au with “Privacy appeal” in the subject. We explain any available complaint route to the relevant state authority. We do not deny protected rights because you made a request. Deletion must include the downstream processor and backup handling required by the applicable law; the general backup schedule does not override those requirements.
5 Additional safeguards
We restrict access and use appropriate safeguards for consumer health data. We do not use location-based boundaries around healthcare facilities to identify or track people seeking health services, collect health information or target messages where that activity is prohibited.
We will provide required notice of material changes and obtain new consent where necessary before a new purpose begins. Related general privacy information is provided separately in our Privacy Notice.
