Operator: ARC INTELLIGENCE PTY LTD, ABN 26 698 244 610, ACN 698 244 610, an Australian private company operating AI Fitness, based in Western Australia, Australia (AI Fitness, we, us). Contact: support@aifitness.com.au.
Version: 1.0. Effective: 16 October 2026. These Terms apply to the AI Fitness app, our related websites and the services we operate under this agreement (Services). An independent third-party service remains subject to its own terms.
1 Agreement and related documents
These Terms govern the AI Fitness Services when you accept them through the applicable signup, purchase or acceptance process. For existing users, changes apply subject to any notice and acceptance required by your existing agreement and applicable law. Publication alone does not provide health-data or marketing consent. You may read and save this version. The Community Standards form part of these Terms when you use social features. Specific purchase terms shown before payment govern the particular purchase, subject to mandatory law.
Our Privacy Notice explains information handling. Acknowledging that notice does not amount to unlimited consent to all processing. Consent required for health information, cloud AI, marketing or another optional activity must be specific to that activity; acceptance of these Terms does not supply it. A regional supplement prevails over an inconsistent general provision to the extent it applies. Nothing here excludes rights or remedies that cannot lawfully be excluded.
2 Eligibility and account security
You must be at least 18 years old and legally able to enter this agreement. The Services are intended for adults. Do not create an account for a child or allow a child to use your account. A store content rating does not change this eligibility requirement. If we discover an ineligible account, we may restrict it and handle its information according to applicable law.
Give accurate registration details, keep your login secure and tell us promptly about suspected compromise. Use a display name if you prefer, provided it does not impersonate someone or mislead others. Do not sell, rent or share account access. You are responsible for your authorised use and for taking reasonable steps to protect access; you are not automatically responsible for unauthorised activity caused by our failure to meet our legal obligations.
3 Scope of the Services
Features may include Coach AI text or voice conversations, exercise demonstrations and plans, movement estimates, workout logging, progress tracking, meal and recipe suggestions, nutrition estimates, kitchen inventory, fasting tools, supplement information, connected-device data, location-based activity, social features and media creation. Availability varies by device, region, subscription and release. The description shown for the feature and purchase should explain what is available.
We provide software and general information. We do not establish a doctor-patient, dietitian-patient or other clinical relationship through these features. We do not prescribe medication, provide medical nutrition therapy, certify physical fitness, diagnose injuries or offer emergency monitoring. A friendly coaching voice, personalisation, scientific terminology or a detailed plan does not make an output a professional clinical opinion.
4 Medical review before activity
Before beginning or following exercise, material dietary changes, fasting or supplement activities through the Services, you must consult a registered or licensed medical practitioner familiar with your circumstances and obtain advice that the activities you propose are appropriate. Tell that practitioner about relevant conditions, symptoms, medication, injuries and restrictions. Seek a qualified dietitian, pharmacist, physiotherapist or other appropriate practitioner where additional expertise is needed. Medical advice about ordinary exercise does not establish suitability for a materially different dietary, fasting or supplement activity; obtain specific advice before starting it.
You must follow the limits and conditions of that advice and obtain renewed advice if your health, symptoms, medication, pregnancy status, injury status or proposed activity materially changes. Do not continue an activity that a practitioner has advised against. Clearance relates to your circumstances and proposed activity; it does not mean that a practitioner has approved every future AI output or that the activity is risk-free.
You must answer any medical-review declaration truthfully and follow relevant restrictions. We do not independently certify your physical fitness or approve a clinician’s advice. An account or completed checkbox is not a medical certificate. Do not send a complete medical record to ordinary support email. Our requirement does not reduce our responsibility to provide the Services with legally required care.
5 Information you provide
Recommendations depend on limited information, including what you enter, measurements, device readings and information available to the selected feature. Provide accurate and current information within your knowledge, use the correct units, and correct mistakes. Do not invent clearance, conceal a relevant limitation when asked, enter someone else’s health details as your own, or deliberately manipulate safety controls.
Review your profile and the assumptions used for a plan before following it. An omitted condition does not mean that the condition is absent; an unanswered question does not establish safety. If a plan relies on incorrect or incomplete information, stop using it until corrected and seek professional advice where needed. Your responsibilities do not transfer our own negligence, unlawful conduct or non-excludable duties to you.
6 Coach AI and automated actions
Coach AI is an automated system. Its answers may be inaccurate, incomplete, outdated, inconsistent or inappropriate, and it can sound confident when wrong. It may misunderstand your speech, images, measurements, intentions or history. It cannot reliably identify all contraindications, medication interactions, emergencies or unsafe movements. There may be delays, lost context and errors in tool use or saved information.
Personalised outputs remain general guidance based on limited inputs. Verify important claims with a suitable professional. Never use Coach AI to make medication decisions, diagnose symptoms, replace clinical treatment or decide whether urgent care is necessary. Do not delay or disregard professional care because an output appears reassuring.
Some features can create or revise plans, record entries or navigate the app at your request. Review proposed changes and resulting records, particularly quantities, units, dates and targets. Check that a change has actually been saved. Tell us about harmful or materially incorrect output using the reporting option where available or support@aifitness.com.au. Reporting does not provide emergency assistance.
7 Exercise and physical safety
Exercise involves physical risks, including strains, falls, overexertion and aggravation of existing conditions. Use appropriate space, lighting, surfaces, clothing and equipment. Check equipment instructions, use qualified supervision or a spotter where appropriate, and select an intensity consistent with professional advice and your current ability. Do not attempt an unfamiliar or hazardous movement merely because the app displays it.
Stop an activity if you experience pain, faintness, chest discomfort, unusual breathlessness or other concerning symptoms, and seek appropriate care. Do not continue to earn points, complete a streak, capture territory or satisfy an AI target. Rest and recovery are part of responsible use. This risk notice explains foreseeable risks; it is not a blanket release of liability for our conduct.
8 Movement estimates and camera features
Pose tracking, repetition counts, joint angles, estimated strength, energy expenditure, inferred muscle activity and form feedback are estimates. Accuracy can vary with camera placement, lighting, clothing, occlusion, body characteristics, movement, device performance and the exercise being tracked. These features do not measure every physiological variable, diagnose injury, guarantee correct technique or certify that lifting a particular load is safe.
Keep the device secure and avoid moving or adjusting it during a hazardous movement. Camera processing, recording and cloud review are different activities. Check the feature’s notice before recording, uploading or sharing. Hiding the camera preview does not necessarily stop processing or recording. Obtain appropriate permission before including others and do not record in private or restricted spaces without authority.
9 Nutrition and meal planning
Meal plans, recipes, portions, calorie targets, macros, nutrient estimates and food-photo analysis are general informational tools. They are not medical diets or treatment for disease, pregnancy complications, eating disorders, deficiencies or other clinical needs. Requirements differ between people and can change. Discuss significant restrictions, weight changes or dietary interventions with an appropriate clinician.
Check ingredient labels, allergens, cross-contact risks, food storage and preparation instructions yourself. AI and scanned labels may omit or misidentify ingredients, quantities, expiry dates or allergens. An allergy entered in your profile is not a guarantee that every suggestion will be free of it. Do not use an uncertain identification to decide whether a food is safe to eat. A pantry reminder or expiry estimate is not a food-safety inspection.
10 Fasting and supplement tools
Fasting and supplement features require particular caution. Do not begin them without the medical review required by section 4. These tools are unsuitable as a substitute for care for pregnancy or breastfeeding, eating disorders, underweight status, metabolic conditions or medication-related risks. Do not interpret the absence of an app warning as clearance.
Do not use AI-generated fasting or weight-restriction plans during pregnancy or breastfeeding, or if you have an eating disorder or are underweight. Where a condition or medication creates a relevant risk, follow a suitably qualified clinician’s individual advice rather than an automated regimen. The app does not supervise that clinical care.
Supplement summaries, suggested routines, label scans, interaction flags and dose information may be incomplete or wrong. Verify the product, formulation, units, warnings and local legality with a doctor or pharmacist. We do not guarantee purity, efficacy, suitability or freedom from drug or sporting-rule interactions. Do not start, stop or alter prescribed treatment because of these tools. Sellers and manufacturers remain responsible for their own products, without limiting any responsibility we have under applicable law.
11 Location features and outdoor activities
GPS, routes, maps, territory, leaderboards and activity replays may be inaccurate or delayed. They are not emergency, rescue or safety navigation services. Use lawful and safe routes, follow road rules and property restrictions, and take account of weather, terrain and other people. Do not trespass, use the app while driving, or let a competitive prompt distract you from a hazard.
Sharing routes or repeated activity locations can reveal where you live, work or spend time, even with approximate locations or privacy zones. Review the audience and route details before sharing. Privacy controls reduce exposure but cannot prevent all inference or copies made by recipients. Location-derived competitive information may have a different audience from your private activity log.
12 Connected services and availability
Device integrations, health-data connections, app stores, video platforms, external websites and third-party services may have their own terms and permissions. Their data may be incomplete or inaccurate. Review the permissions you grant and disconnect integrations you no longer want. We remain responsible for our own processing and representations.
The Services depend on compatible devices, networks and supporting systems. We use reasonable care in providing them, but cannot promise uninterrupted access or error-free AI outputs. We may make proportionate updates for maintenance, security, law or functionality. Section 23 applies where a change materially affects a paid service.
13 Your content and private information
You retain the rights you hold in your posts, photos, videos, messages and other contributions (Your Content). Provide only material you have authority to submit. Do not include another person’s confidential or sensitive information without an appropriate lawful basis and permission. You remain responsible for statements you choose to publish.
To operate the features you request, you grant us a non-exclusive, royalty-free licence to host, store, copy, format, transmit and display Your Content to the audience you select, and to process it for security, support and moderation under the Privacy Notice. The licence is worldwide only as needed for service delivery and permitted processing. We may permit contracted service providers to perform those activities for us, subject to appropriate obligations.
This is not a transfer of ownership or a general right to use private health data, photos or messages in advertising or to train general-purpose AI models. Such uses require a separate lawful basis and any necessary specific consent. The licence ends when content is deleted from our operational systems, except for limited copies retained for lawful purposes, backup expiry or recipients’ independently retained copies as explained in the Privacy Notice.
14 Community participation
The Community Standards apply to profiles, posts, comments, forums, messages, shared plans, media, rankings and other social features. Public or shared content can be seen and copied by its audience. Private messaging does not imply medical confidentiality or verified professional advice. We do not promise that every user is who they claim to be or that every contribution has been reviewed.
Other users’ experiences and AI-generated posts are not individual medical recommendations. Do not follow a risky challenge or unverified health claim. Report abusive, unlawful, infringing or unsafe content through the reporting tools or support. Use blocking and audience controls where available. We may act under the moderation process described in the Community Standards.
15 Our software and intellectual property
We and our licensors retain the rights we hold in the software, source and object code, design, original materials, databases, trademarks and branding. Subject to these Terms and any purchase, we grant you a limited, personal, non-exclusive and non-transferable licence to use the Services for your own lawful fitness and wellbeing purposes.
Applicable app-store licence terms and entitlements prevail to the extent they confer rights that this agreement cannot restrict, including any applicable authorised sharing rights. This does not permit sharing account credentials or private health records.
You must not copy, sell, sublicense or redistribute our protected materials or software without permission; remove ownership notices; use our branding to suggest endorsement; or obtain private source code, credentials, model assets or confidential implementation information by unauthorised means. Do not decompile, disassemble, reverse engineer or bypass technological protections except to the extent an applicable non-waivable law or an applicable open-source licence permits it.
Open-source and third-party components remain subject to their licences. These Terms do not remove rights granted by those licences. We do not claim ownership of all ideas, facts, exercise methods or all AI-generated material. You may use outputs provided to you for your personal fitness purposes, subject to third-party rights and safety limits. AI output may resemble other output and may not qualify for copyright protection. Commercial reuse of our protected templates, media or branding requires permission; this does not restrict uses the law independently permits.
16 Security and prohibited misuse
Do not access another person’s account or data without authority, intercept traffic unlawfully, introduce malware, steal credentials, bypass authentication or payment controls, overload the Services, exploit vulnerabilities to cause harm, or evade a valid suspension. Do not scrape private data, create spam accounts, manipulate leaderboards, impersonate staff, or use bots to extract protected material or disrupt normal operation.
Do not use prompts, uploaded files or manipulated inputs to obtain another user’s information, reveal secrets, defeat access controls or cause unauthorised actions. We may apply proportionate technical limits and investigate credible misuse. Such measures do not remove privacy rights, lawful interoperability rights or other statutory exceptions.
Report a suspected vulnerability to support@aifitness.com.au with a safe description and minimal evidence. Do not send exposed health records or credentials in an ordinary email. Seek written testing scope before active testing beyond what the law independently permits. Do not extort, threaten disclosure of personal data or continue accessing records to demonstrate a flaw. This reporting invitation does not authorise destructive testing or promise a bounty. We will assess good-faith reports on their facts.
17 Copyright and other rights complaints
Send a rights complaint to support@aifitness.com.au identifying the protected work or right, the material and its location, your contact details, your authority and why the use is unauthorised. Provide accurate information. We may request clarification, restrict material where justified, notify the uploader and consider a response or applicable counter-notice. We may restrict repeat infringement in appropriate circumstances.
We follow legally required notice procedures where they apply. This clause does not claim automatic immunity for hosting content or identify an unregistered contact as a registered US copyright agent. A US statutory notice process, if adopted, will identify the registered agent and applicable procedure separately.
18 Subscriptions and purchases
Before purchase, the checkout must disclose the price and currency, billing interval, included features, trial period if any, renewal conditions and how to cancel. A subscription may renew automatically until cancelled in the relevant store or billing channel. We request any consent required for renewal or a change of price. Do not assume a trial is free beyond the period stated at checkout.
We will not begin recurring charges without the required clear disclosures and your affirmative consent. For any direct-billed subscription, we provide a clear, readily accessible way to stop future charges by contacting support@aifitness.com.au from your account email, as well as any cancellation control provided at checkout, together with confirmation of your request. Store subscriptions use the relevant store controls. These arrangements remain subject to additional local cancellation requirements.
For Google Play purchases, manage renewal through the subscription controls in your Google Play account. Cancellation normally stops the next renewal and access ordinarily continues to the end of the paid period, subject to the purchase terms and applicable law. Uninstalling the app does not itself cancel a store subscription. When requesting account deletion, check and cancel any continuing subscription; we will provide reasonable assistance and any cancellation mechanism we are required to provide.
We do not exclude statutory refund, cancellation, withdrawal or compensation rights. Store policies may provide additional remedies but do not replace remedies you have against us. If a paid service fails to meet a legally required guarantee, contact us or the billing channel for the applicable remedy. We will not direct you away from a responsibility the law places on us.
19 Marketing and service communications
Joining AI Fitness does not by itself subscribe you to promotional emails. Promotional emails require a separate affirmative marketing choice under these Terms. You can unsubscribe at any time using the message link or by contacting support. We will honour opt-outs within applicable deadlines.
We may still send necessary security, billing, account, policy and service messages. We do not use that category to disguise advertising. Optional push notifications and other marketing channels have their own settings and any required permissions. We do not sell or transfer marketing permission merely because you accepted these Terms.
20 Privacy and data choices
The Privacy Notice explains what stays on the device, what may be processed in the cloud, how information is shared, and available rights. Providing a health field is not permission to publish it to the community. Selecting a community audience is not permission to use that information for unrelated advertising.
Some features require particular information or permissions. If you decline or withdraw consent, the affected feature may be unavailable. We explain the effect at the point of choice. Privacy access, complaints and deletion routes remain available. Withdrawing marketing consent does not remove access to the app.
21 Outcomes and professional reliance
Results vary with individual circumstances and factors outside the Services. We do not guarantee a particular weight change, strength result, appearance, performance improvement, injury prevention or health outcome. A statistic, testimonial, forecast or illustrative example is not a promise about your results.
To the extent permitted by law, you must not represent the Services or their outputs as certified medical advice or as our approval of a clinical, employment, insurance or other high-stakes decision. If you are a professional, you remain responsible for your professional duties and must obtain a suitable agreement before using the Services for patients or clients.
22 Responsibility and limits of liability
Mandatory rights come first. Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law. We do not exclude liability for fraud, deliberate wrongdoing, or death or personal injury caused by negligence where exclusion is prohibited. We do not use these Terms to waive statutory privacy or data-protection rights.
Subject to those rights, we are responsible for loss to the extent it is caused by our breach of this agreement or our other legally actionable conduct. We are not responsible for a loss to the extent it was caused by your intentional unlawful conduct, your deliberate falsification of relevant information or a third party’s independent conduct for which we are not legally responsible. Causation and contribution are assessed under applicable law; merely using AI or encountering a warning does not decide them.
The Services are supplied for personal use. Subject to mandatory rights, we do not accept liability for business profits, business opportunities or commercial reliance outside the permitted purpose where such loss was not reasonably foreseeable. We do not impose a general monetary cap on consumer claims under these Terms. Acknowledging physical risk is not an agreement to release us from all liability.
23 Changes to the Services and these Terms
We may make changes reasonably needed for security, legal compliance, compatibility, product development or operation. We will explain material changes to these Terms and give reasonable advance notice, ordinarily at least 30 days, unless a shorter period is reasonably necessary for security or law. Changes do not retrospectively remove accrued rights or retrospectively authorise a new use of personal information.
If a material adverse change to a paid service is unacceptable to you, you may cancel the affected service without penalty and receive a proportionate refund for the prepaid unused period, in addition to any greater remedy required by law. We will explain how to exercise this right in the change notice. We will seek renewed acceptance or separate consent where required. If you do not accept revised Terms, you may stop using the affected service and close your account without losing rights relating to earlier use. We will not treat continued use as health-data or marketing consent where an affirmative choice is required.
24 Suspension and termination
We may restrict an account or feature on reasonable grounds, including a material breach, credible security threat, serious community harm, non-payment or legal requirement. We choose a proportionate response and, where appropriate, give notice, an explanation and an opportunity to correct the issue or appeal. Immediate restriction may be necessary to protect people, evidence or systems, or to comply with law.
You may stop using the Services and request account deletion. If we discontinue a paid service for reasons unrelated to your breach, we provide any refund or other remedy required by law. A suspension does not automatically forfeit all paid fees or remove access to complaints and statutory data rights. Relevant payment obligations, limited content licences for lawful retained copies, accrued rights and provisions that logically continue survive termination.
25 Deliberate misuse and third-party claims
To the extent permitted by law, if your intentional unlawful misuse or knowing infringement of a third party’s intellectual property through the Services directly causes a third-party claim against us, you are responsible for the reasonable loss and defence costs attributable to that conduct. This does not cover an ordinary mistake, a lawful complaint, a good-faith statutory claim or loss caused by our own fault.
We must notify you reasonably promptly, take reasonable steps to limit loss and allow a reasonable opportunity to participate in the response. We will not agree to a settlement for which we seek reimbursement from you, which admits your liability or which imposes a non-monetary obligation on you without your consent, which must not be unreasonably withheld. This clause does not require you to pay our legal costs simply because you complain or bring a claim against us.
26 Export controls and sanctions
You must not access, supply, transfer, export, re-export or use the Services in a way prohibited by applicable export-control or sanctions laws. Do not misrepresent information or use technical measures to evade a legally required restriction. We may restrict distribution or access where reasonably necessary to comply with those laws and will consider any applicable authorisation or exception.
Applicable requirements may include Australian laws and US rules relevant to US-origin technology or service providers, as well as other laws that apply to the transaction. This is not a statement that every US trade law applies to every user, or that ordinary use involves the importation of physical goods. We remain responsible for our own compliance duties.
27 Complaints and disputes
Contact support@aifitness.com.au with the issue and the remedy you seek. We will consider it in good faith, acknowledge it promptly and aim to provide a substantive complaint outcome within 30 days, or sooner where required. For Google Play paid-product and in-app-transaction support enquiries, we respond within three business days; concerns Google designates urgent receive a response within 24 hours. These are response commitments, not guarantees that every issue will be resolved in that period. An informal complaint process does not prevent urgent relief, regulator contact, a statutory complaint or proceedings within a legal time limit.
Western Australian law governs this agreement, subject to mandatory consumer and other laws that apply to you. Western Australian courts have non-exclusive jurisdiction. If mandatory law allows you to bring a claim in your home jurisdiction or requires another forum, that right is preserved. These Terms do not impose compulsory arbitration, a class-action waiver or a shortened statutory claim period.
28 General provisions
If a provision is invalid, the remainder continues so far as legally possible; an unfair term is not made fair merely by this sentence. A delay in enforcing a right does not waive it. We may transfer this agreement as part of a lawful business transfer only where doing so does not materially reduce your protections, and we will give any required notice. You may exercise any statutory transfer rights. This agreement does not exclude liability for misleading statements made before you accepted it.
For notices, support and accessibility assistance, contact support@aifitness.com.au. Additional regional rights appear in Regional Supplements.
